Regulation 22 (3) of the Town and Country Planning (Local Planning) (England) Regulations 2012.
The Scarborough Borough Local Plan (2011-2032) was submitted to the Secretary of State for Communities and Local Government via the Planning Inspectorate for formal examination on 9 May 2016. The Inspector will consider whether the document complies with the legal requirements and whether the document is ‘sound’.
Part of the examination process will involve public hearing sessions where those invited to participate by the appointed planning inspector will have the opportunity to respond to matters identified. Public Hearings have taken place at Scarborough Town Hall between 16 August 2016 and 8 September 2016. Proposed main modifications to the Scarborough Local Plan were subject to public consultation between 21 September and 3 November 2016. The Inspector has now decided that it is necessary to hold a further hearing session which will commence at 10.00 on Tuesday 24 January 2017 at Scarborough Town Hall. The Inspector’s Guidance Note published on 17 May 2016 (EX-3] contains information that is relevant to the further hearing sessions.

Inspector William Fieldhouse BA (Hons) MA MRTPI has been appointed to conduct the examination to determine whether Scarborough’s Local Plan is sound. All correspondence with the Inspector must be made through the Programme Officer - no direct contact with the Planning Inspector is permitted.
Liz Dowson has been appointed as the independent Programme Officer for the Examination in Public.
The Programme Officer will act as the contact for any person who has an interest in the Examination and as a liaison between the Inspector, Scarborough Borough Council and Representors, and works on behalf of the Inspector to organise and manage the administrative and procedural aspects of the examination process. She is the appropriate point of contact for any questions relating to timetabling or procedural matters. All statements related to the hearing sessions will also be submitted through her.

Following consideration of the plan by the appointed Inspector through the hearing sessions in August and September 2016 and most recently January 2017, the Inspector has now issued his Final Report into the soundness of the Scarborough Borough Local Plan. This is a response received in relation to HA28 from Mr and Mrs Bleasdale who are now unable to attend the hearing session on 24th January.
The Inspector has published the hearing agenda for the Hearing Sessions at 10.00am on Tuesday 24 January 2017.
The Inspector has decided to hold a further hearing session following consultation on Proposed Main Modifications to the Scarborough Local Plan. The hearing session will commence at 10.00 on Tuesday 24 January 2017 at Scarborough Town Hall. Discussion will be limited to HA28 (land to west of Napier Crescent, Seamer) and HA30 (land to south of Racecourse Road, East Ayton). Anyone who made representations in response to the proposed main modifications relating to these two sites who wishes to participate at the hearing session should contact the Programme Officer by midday on Friday 2 December 2016.
Further to the Inspector’s “Next Steps” note published on 9th September 2016, the Council has prepared a report summarising the main issues raised; and a brief response to those main issues (Ref: PM-05). The Inspector is now considering all of the representations about the proposed main modifications, along with all of the evidence submitted to the examination, and expects to finalise his report around the end of the year.

The public consultation on the Main Modifications (Ref: PM-01) to the Local Plan, together with Sustainability Appraisal (Ref: PM-02) and Habitats Regulations Notes (Ref: PM-03), has now ended. You can view all representations received on our consultation portal (Ref: PM-04).
Please note that the Modifications Document (PM-01) has been updated as it has been noted that whilst the indicative yields were correct within the Housing Trajectory these changes had not been included under Policy HC2 or the Housing Allocation Statements.
These changes relate to the indicative yields of sites HA11 (Land to west of Church Lane, Cayton), HA18 (Land adjacent to Captain Cook Crescent, Whitby) and HA20 (Land to south of Upper Bauldbyes, Whitby). This has been rectified and the indicative number of dwellings proposed under Policy HC2 has also been updated accordingly.
The supporting Sustainability Appraisal (PM-02) has been updated to take into account these changes.
A schedule of Main Modifications (Ref: PM-01) to the Local Plan, together with Sustainability Appraisal (Ref: PM-02) and Habitats Regulations Notes (Ref: PM-03), will be available for public consultation between 21 September 2016 and 5pm on Wednesday 2 November 2016.

The Council will then consider those comments before submitting main modifications on Friday 9 September for consideration by the Inspector.
The date for the Council to provide their main modifications in relation to additional sites and the trajectory has been changed from Wednesday 7 September to Friday 9 September. This is the only change in the following updated document.
Further to the Inspector’s interim findings relating to matters 2 and 3 housing requirements and supply (EX14), the Council has produced two documents EX14R(A) and EX14R(B) which can be found below. Any comments about these should be sent to the Council by midday on Wednesday 31 August. The Council will then consider those comments before submitting main modifications on Monday 5 September for consideration by the Inspector.
Natural England has provided a further response to confirm they are now content with the additional information provided and the impact on air quality within the North York Moors National Park protected areas. The letter below confirms their position.
